Terms of Service

1. Acceptance of Terms

By creating a CloakAPI account, you agree to these Terms of Service. If you do not agree, do not use the service.

2. Service Description

CloakAPI is a privacy-focused AI API gateway that routes your requests to third-party AI providers. The CloakAPI desktop application performs client-side PII tokenization so that sensitive information is anonymised before it leaves your device.

3. Prepaid Credits and Billing

  • Credits are prepaid and non-refundable unless required by law.
  • Credits are deducted per API request based on token usage plus a service markup (20–40%).
  • You will receive an email notification when your balance falls below $2.
  • Requests will be rejected with a 402 status when your balance reaches zero.
  • Minimum top-up is $5. Maximum single top-up is $1,000.

4. Acceptable Use

You may not use CloakAPI to:

  • Generate illegal content or content that violates the terms of the underlying AI providers
  • Circumvent safety measures of AI providers
  • Engage in fraud, spam, or abuse of the service
  • Resell access to CloakAPI without written permission
  • Attempt to extract, reverse-engineer, or disrupt the service infrastructure

5. API Keys and Account Security

You are responsible for keeping your API keys secure. CloakAPI stores only SHA-256 hashes of keys. If a key is compromised, rotate it immediately via the dashboard. You are liable for all usage charged to your account keys.

6. Privacy and Data

CloakAPI does not log AI request or response content. See our Privacy Policy for full details.

7. Service Availability

CloakAPI is provided "as is". We do not guarantee 100% uptime. We are not liable for downtime of third-party AI providers. We will make reasonable efforts to provide a stable service but give no SLA warranties to free or standard accounts.

8. Limitation of Liability

To the maximum extent permitted by law, CloakAPI's liability is limited to the amount you paid for the service in the 30 days preceding the claim. We are not liable for indirect, consequential, or incidental damages.

9. Termination

You may delete your account at any time via Settings. We may suspend or terminate accounts that violate these terms. Unused prepaid credits will not be refunded upon termination for policy violations.

10. Changes to Terms

We may update these terms at any time. Material changes will be communicated by email. Continued use of the service after notification constitutes acceptance of the revised terms.
